Court Reinstates Taraba’s Bwacha, Adamawa’s Binani

THE Court of Appeal sitting in Yola has reinstated Senator Emmanuel Bwacha and Aishatu Binani as the All Progressives Congress (APC) senatorial and governorship candidates for Taraba and Adamawa states.

Stonix News reports that a high court sitting in their respective states had earlier disqualified the primaries that produced the duo as candidates.

However, in its sitting on Thursday, the court ordered that their names be forwarded to the Independent National Electoral Commission (INEC) as the authentic APC Senatorial and governorship candidates.

Recall that in September, Justice Simon Amobeda of a Federal High Court in Jalingo, the Taraba State capital, sacked Bwacha after a petition by a former aspirant, David Kente.

The Presiding judge had ruled that it was impossible for all the primary result sheets to have the same handwriting.

The returning officer had declared that no primary was held in the state at the police headquarters due to security threats.

Dissatisfied with the ruling of the lower courts, Bwacha filed an appeal, alleging that the ruling Peoples Democratic Party (PDP) in Taraba State was the major cause of the APC problems within the state.

In the same vein, a Federal High Court in Yola, Adamawa State, presided over by Justice Abdulaziz Anka, had nullified the APC primary that produced Binani as the gubernatorial candidate.

He had declared that the APC has no gubernatorial candidate in the state because of the non compliance with the electoral guidelines and the constitution.

One of the the aspirants, Nuhu Ribadu, had dragged Binani and INEC before the high court, alleging vote buying and illegal delegates list at the primary conducted on May 27, 2022.

In its rulings on Thursday, the appellate court set aside the judgements and reinstated both candidates.
