THE Delta State High Court of Justice, Orerokpe Judicial Division, Okpe Local Government Area, on Wednesday, December 17, granted an ex parte order restraining the Inspector-General of Police (IGP), Kayode Egbetokun, the Delta State Commissioner of Police, CP Olufemi Abaniwonda, and their officers from enforcing the Tinted Glass Permit Policy pending the determination of a substantive suit.
The court also fixed Wednesday, December 24, for the hearing of the suit instituted by a human rights activist, Comrade Israel Joe.
Comrade Joe, in Suit No: HOR/FHR/M/31/2025 against the IGP and the Delta State Commissioner of Police, was represented by a Senior Advocate of Nigeria (SAN), Mr Kunle Edun, alongside Ikechukwu Ogbonna Esq., E.O. Onoriode Esq., S.C. Okporgu Esq., T.L. Doigboghie Esq., A.H. Okifo Esq., Sir F.O. Yekovie, and J.K. Ezugwu Esq.
In the enrolled order, the applicant prayed the court for an interim injunction restraining the 1st and 2nd respondents, their officers, agents, privies and/or contractors from implementing or enforcing the Tinted Glass Permit Policy scheduled to commence on January 2, 2026, pending the hearing and determination of the substantive application.
He further sought an order restraining the respondents and their agents from stopping, harassing, arresting, detaining, extorting, or otherwise interfering with the constitutional rights to dignity, privacy, freedom of movement and ownership of property of the applicant and other citizens or motorists under the guise of enforcing the policy.
The applicant also prayed the court to restrain the respondents from continuing to use the Parkway Projects account, said to belong to a private contractor, to conduct any government business pending the determination of the substantive suit.
Additionally, he sought an order for substituted service on the 1st and 2nd respondents through the 3rd respondent at the Delta State Police Command Headquarters, Asaba, with such service deemed proper and effective.
When the matter was called, the applicant was absent, but his counsel, Mr Kunle Edun, SAN, and other members of the legal team were present.
Presiding over the matter, His Lordship, Hon. Justice Joe Egwu, having heard submissions from counsel, ordered that the motion ex parte dated and filed on December 17, 2025, be granted as prayed and fixed December 24, 2025, for hearing.
Reacting to the ruling, Comrade Joe described the order as a victory for democracy and urged the Inspector-General of Police to obey the court order and discontinue any planned enforcement of the policy.
