ABUJA – The Federal High Court in Abuja has declared that former President Goodluck Jonathan is eligible to contest the 2027 general elections, dismissing a lawsuit that sought to bar him from any future presidential race.
Justice Peter Lifu delivered the judgement on Tuesday, ruling that the case lacked merit and amounted to an abuse of court process, particularly as the issue of Jonathan’s eligibility had already been determined by superior courts.
The suit had argued that the former president was constitutionally barred from running again because he had taken the presidential oath of office twice.
The plaintiff asked the court to disqualify Jonathan from participating in any future presidential election.
However, Justice Lifu held that the matter had already been settled by previous judicial pronouncements, including decisions of the Federal High Court and the Court of Appeal, rendering the fresh suit unnecessary and repetitive.
According to the judge, the court could not revisit issues that had already been conclusively determined by courts of competent jurisdiction.
“I am bound by the above decision of the Court of Appeal and this court. I have no more to add,” Justice Lifu stated while delivering the judgement.
The judge further described the suit as a waste of judicial time and resources, stressing that repeated litigation on the same subject constituted an abuse of the legal process.
As part of the ruling, the court awarded costs against the plaintiff, ordering the payment of N20 million in favour of Jonathan.
An additional N1 million was also awarded in favour of the Attorney-General of the Federation.
The judgement is expected to reignite political discussions over Jonathan’s possible return to active presidential politics ahead of the 2027 elections.
The former president, who served from 2010 to 2015, has repeatedly been linked with speculation about a potential comeback bid, although he has not formally declared any intention to contest.
